This thesis is contained in a brief expected to be filed today by the Justice Department in the John R. Thompson Co. case, which challenges the right of restaurant operators to exclude Negro patrons. The case arose after a group of Negroes were denied service in a Thompson restaurant here. The Negroes contend their exclusion violated the "lost" Equal Services Acts of 1872-1873 passed by the old Legislative Assembly of the District of Columbia. Appeal Pending Their case was thrown out in Municipal Court but the decision was reversed in the Municipal Court of Appeals. It is now pending in the United States Court of Appeals where the Justice Department is filling its brief as a "friend of the court." The brief itself is a denunciation of racial dscrimination in the Nation's capital. But, the Thompson lawyers have insisted that the Equal Services Acts were beyond the powers of the Legislative Assembly and are unconstitutional. To meet this argument, the Justice Department says flatly that home rule is Constitutional. If this contention is upheld, it will remove once and for all the oft-advanced claim that a Constitutional amendment is needed for self-government here. 'Misleading Impression' The Justice Department in its brief filed through Solicitor General Philip B. Perlman, and Attorneys Philip Elman and T.S. L. Perlman, said it wants to enter the case because "the problem of racial discrimination in the District of Columbia, the Nation's capital, is a matter of serious concern to the pepole of the entire country and not merely those who live in this area...Racial discrimination in Washington thus assumes exaggerated importance in conveying a misleading impression of American life." 1531 10th St NW Wash.
